A Landmark Case For Immigrants And Marriage
The U.S. Supreme Court found part of the Defense of Marriage Act (“DOMA”) unconstitutional on June 26, 2013, in the case U.S. v. Windsor. This decision led to the Board of Immigration Appeals (BIA) issuing its own decision that same-sex marriage licenses must be recognized for purposes of U.S. immigration law as long as the marriage was considered valid under the laws of the country where the couple was married.
