President Biden’s Parole in Place Program for Undocumented Spouses of U.S. Citizens

It’s here! Starting today, August 19, 2024, eligible undocumented spouses of United States citizens can begin applying for Parole in Place. This program will likely face future legal challenges or could even be canceled under a new presidential administration. Based on what we know today, we recommend that eligible applicants apply as soon as possible.

What is Biden’s New Parole in Place Program? 

To recap, the Biden administration Parole in Place program is a new process that will allow certain undocumented people to apply for lawful permanent residence (green card) inside the United States without having to leave the country to complete their immigration process.

Who may benefit? 

Spouses and children of U.S. citizens who have been living in the United States for at least 10 years.

You may be eligible to apply for your green card without leaving the United States, if, as of June 17, 2024:

  • You are in the United States after entering without permission;
  • You have lived in the United States for at least 10 years and have never left;
  • You are legally married to a U.S. citizen or have a qualifying stepchild relationship with a U.S. citizen; and
  • You do not have certain criminal history or pose a threat to national security or public safety.

What is the process? 

The application process is up and running and is filed online at USCIS beginning today,  August 19, 2024.

What can I do to prepare?

  • Gather evidence showing you have been in the U.S. for at least 10 years
  • Collect your marriage certificate
  • Collect evidence of your spouse’s U.S. citizenship, such as the spouse’s U.S. birth certificate, U.S. passport or naturalization certificate
  • Collect any additional documents, such as criminal records.
